Lawsuit Filed Against Hayward Toyota

Hayward Toyota Sued for Allegedly Falsifying Down Payment

On December 8, 2011, the Vachon Law Firm filed the complaint for the lawsuit Gordon-Brown v. Auto Mission, Ltd. in the Alameda County Superior Court (Case No. HG11607769). The defendant, Auto Mission, Ltd., operates the well-known car dealership “Hayward Toyota” in Hayward, California. The plaintiff is an Oakland, California consumer who is represented by the Vachon Law Firm.

Lawsuit’s Allegations Against Hayward Toyota

The complaint alleges that Hayward Toyota falsified the down payment amounts in the plaintiff’s October 2011 vehicle purchase contract. The complaint further alleges that this amounts to a violation of the Automobile Sales Finance Act and entitles plaintiff to rescind the contract.

The complaint also alleges that the vehicle sold by Hayward Toyota became inoperable within one month of the sale and that this amounts to a breach of the implied warranty of merchantability.
