J.S. Auto Sales & Towing Settles California Lemon Law Claim Prior to Lawsuit
J.S. Auto Sales Resolves Dispute Prelitigation
The Vachon Law Firm has announced the resolution of a Fresno, California consumer’s dispute with J.S. Auto Sales & Towing of Kerman, California. The parties settled in response to a demand letter sent by the Vachon Firm, without the filing of a lemon law lawsuit.
The September 8, 2011 demand letter to J.S. Auto Sales & Towing stated that a J.S. Auto Sales & Towing customer was complaining that the dealership had sold him an accident-damaged Chevrolet Malibu without disclosing the damage, sold the vehicle for more than its advertised price, failed to tell the buyer that the vehicle had previously been registered as a rental car, and breached the implied warranty of merchantability.
Upon receipt of the demand letter, J.S. Auto Sales & Towing agreed to a mutually acceptable settlement, in which J.S. Auto Sales & Towing did not admit any wrongdoing, but pursuant to which it forgave the entire outstanding loan balance on the consumer’s Chevrolet Malibu.
